The Section Studio Terms & Conditions

By purchasing, downloading, or otherwise accessing The Section Studio (the “Product” or “Library”), you (“Customer,” “You,” or “Licensee”) are entering into a binding agreement with Bungalow Creative (“We,” “Us,” or “Our”). These Terms & Conditions govern your use of the Product and any accompanying materials, updates, or resources provided. By completing your purchase, you acknowledge that you have read, understood, and agreed to these Terms in full. If you do not agree, you may not access or use The Section Studio. These Terms apply to all methods of access, whether through our website, a third-party platform, or direct distribution, and remain in effect for as long as you hold a license to the Product.

1. License Grant

You are granted a limited, non-exclusive, non-transferable, single-seat commercial license to install and use the sections provided through The Section Studio in an unlimited number of personal and client Shopify projects.

As the sole license holder, you may adapt and customize the sections to meet the needs of each project and incorporate them into client deliverables, provided they form part of a larger, meaningful build such as a complete Shopify site or significantly customized template.

This license is issued to one individual only and does not extend to partners, employees, subcontractors, or collaborators without the purchase of additional licenses. Any rights not expressly granted remain the exclusive property of Bungalow Creative.

You may not assign, transfer, or sell your license to another party without prior written consent from Bungalow Creative.

As part of this license, you are permitted to download and store a local copy of the codebase on your own computer or secure storage system for personal and client use. This right ensures you may continue to access the sections even if The Section Studio is no longer actively maintained or distributed. Local copies remain subject to all restrictions in these Terms and may not be shared, sold, or redistributed.

2. Restrictions

You may not resell, redistribute, or sublicense the sections in their original form or with only superficial modifications, nor may you package them in whole or in part into a competing product, theme, template, library, or marketplace offering. The sections may not be used to create a product or service where the primary value is the section itself, such as Shopify section packs, template bundles, or other offerings that replicate or compete with the purpose of The Section Studio.

Your license is for your use only and may not be shared, transferred, or otherwise distributed to other individuals, teams, or agencies, whether for free or for profit.

Any attempt to bypass these restrictions, including but not limited to reselling code under a different name, distributing login credentials, or embedding the sections into a product marketed for resale, will result in immediate termination of your license and may result in legal action.

3. No Refund Policy

All sales of The Section Studio are final. Because the Product consists of digital files and immediate access to proprietary content, no refunds, exchanges, or cancellations will be provided under any circumstances once access has been granted.

By completing your purchase, you acknowledge that you have had the opportunity to review the details of the Product and understand exactly what is being offered. Refund requests based on factors such as a change of mind, incompatibility with a specific theme or app, lack of usage, or a mistaken purchase will not be honored.

4. Payment Terms

If you purchase The Section Studio through a one-time payment, the full balance is due at checkout. If you choose a payment plan, you are responsible for completing all scheduled installments on time.

Failure to make payments when due may result in immediate suspension or termination of your license without refund of amounts already paid. Bungalow Creative reserves the right to pursue collection of outstanding balances through a third-party collections agency, and you agree to be responsible for any additional fees, costs, or expenses incurred in the collection process. Access to The Section Studio is conditional upon full payment, and any unpaid or defaulted accounts may have their license revoked permanently without refund.

All prices are listed in U.S. dollars unless otherwise stated. You are responsible for any applicable taxes, duties, or transaction fees imposed by your jurisdiction.

5. Ownership & Intellectual Property

The Section Studio and all related content, including but not limited to source code, design elements, documentation, video walkthroughs, and community resources, remain the sole intellectual property of Bungalow Creative. Your purchase grants you a limited license to use the Product under the terms outlined herein; it does not transfer ownership of any kind. While you may adapt and incorporate sections into client projects or customized templates as part of a broader deliverable, you may not resell, redistribute, or repackage the sections themselves in a way that makes them the primary value of the product. Any unauthorized reproduction, resale of the sections in standalone form, distribution of unmodified code, sublicensing, or public sharing of The Section Studio, in whole or in part, constitutes copyright infringement and a breach of contract. Bungalow Creative reserves the right to revoke your license immediately, pursue damages, and take legal action to the fullest extent permitted by law in the event of such violations.

6. Account Access

Access to The Section Studio is licensed to a single seat, meaning one individual only. The license is tied to you as the purchaser and may not be shared, transferred, or split between multiple people, whether within the same organization or across different entities. Sharing login credentials, project files, or downloaded assets with unlicensed users is strictly prohibited. If you operate as part of an agency or team, each designer, developer, or implementer who requires access must obtain their own individual license. Bungalow Creative reserves the right to monitor access for unusual activity that suggests account sharing, and any violation of this policy may result in immediate suspension or termination of access without refund.

7. Support

Purchases include:

• Access to the complete Section Studio codebase, organized in a filterable format for easy browsing and implementation.
• Access to video walkthroughs demonstrating how to install and use the sections.
• Access to a private community for peer-to-peer support, idea sharing, and limited direct input from Bungalow Creative.

We do not guarantee support for:

 

• Custom coding or modifications made to the sections beyond what is provided in The Section Studio.
• Conflicts or incompatibilities caused by third-party apps, themes, or platform updates outside of our control.
• Troubleshooting issues on heavily customized, outdated, or unsupported Shopify themes.
• The inclusion of stock photography, imagery, or assets shown in example sections or demo materials.
• Design guidance, strategy advice, or best practice recommendations outside of the core video walkthroughs.
• Performance results, SEO outcomes, or specific business metrics tied to your implementation of the sections.
• Errors introduced by client-side edits, misconfigurations, or alterations to the provided codebase.
• Requests for new features, custom design patterns, or one-on-one development services.
• Sections labeled as “production-ready” have been tested for functionality in Safari 14 and newer, Chrome 90 and newer, and for responsive display down to an iPhone X screen size. Compatibility outside of these parameters is not guaranteed.
• Ongoing updates to ensure compatibility with every future Shopify change, feature release, or third-party integration.
• Migration, hosting, or non-Shopify related technical support.

 

If you encounter what appears to be a genuine bug in the provided codebase, you may report it through the designated channel provided. While Bungalow Creative will review such reports in good faith, we make no guarantee of response time or resolution. Any fixes or updates are provided solely at our discretion. Submitting a bug report or feature request does not create an obligation for Bungalow Creative to resolve the issue, provide a fix, or issue an update.

8. Updates

Bungalow Creative may, at its discretion, release updates, improvements, or additional sections to The Section Studio library. These updates may include bug fixes, refinements to existing sections, or new features designed to expand the library. Lifetime access refers to the continued availability of The Section Studio as a product offered by Bungalow Creative, not the lifetime of the purchaser. While we aim to maintain and improve the library over time, we make no guarantee of ongoing updates, new releases, or compatibility with every future Shopify change, feature release, or third-party integration. Bungalow Creative reserves the right to add, modify, or remove content from the library at any time without prior notice.

9. Liability

The Section Studio is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. Bungalow Creative expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not represent or warrant that the sections will be error-free, free of defects, compatible with every Shopify theme, app, or platform update, or uninterrupted in functionality.

We make no guarantee that the use of The Section Studio will meet your specific requirements, achieve any desired business outcome, or operate without downtime or technical issues. Any reliance on the sections is at your sole risk, and you assume full responsibility for testing, implementation, and integration into your development and live environments.

To the fullest extent permitted by law, Bungalow Creative shall not be liable for:

• Loss of revenue, profits, anticipated savings, goodwill, reputation, or business opportunities.
• Downtime, theme breakage, data corruption, or data loss resulting from installation, customization, or use of the sections.
• Any indirect, incidental, punitive, special, exemplary, or consequential damages, even if Bungalow Creative has been advised of the possibility of such damages.

In all cases, the total aggregate liability of Bungalow Creative for any claim related to The Section Studio, whether in contract, tort, or otherwise, shall not exceed the amount you paid for access to the Product. You acknowledge that these limitations of liability are an essential basis of the bargain, and that The Section Studio would not be provided without them.

You assume full responsibility for the installation, implementation, and ongoing use of the sections within both your development and live environments. It is your obligation to properly test, review, and confirm that the sections function as intended before deploying them on a live site. Bungalow Creative is not responsible for errors, conflicts, or issues that arise from your failure to follow appropriate development practices, including but not limited to version control, staging, backups, and quality assurance testing.

Bungalow Creative shall not be held liable or responsible for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to platform changes, third-party outages, or other force majeure events.

Bungalow Creative makes no representations or warranties that the sections provided through The Section Studio comply with any specific accessibility standards, guidelines, or regulations (including but not limited to WCAG, ADA, or any similar laws or frameworks). You acknowledge and agree that it is solely your responsibility to review, test, and ensure that any website or project incorporating these sections complies with applicable accessibility requirements.

To the fullest extent permitted by law, you expressly release, discharge, and hold harmless Bungalow Creative, its owners, employees, contractors, and affiliates from any and all claims, demands, damages, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to accessibility, disability access, or discrimination lawsuits, complaints, audits, or enforcement actions connected in any way to your use of The Section Studio.

10. Termination

We reserve the right to revoke, suspend, or permanently terminate your license and access to The Section Studio at any time, without refund, if you are found to be in violation of these Terms. Violations include but are not limited to reselling or redistributing the sections, sharing or transferring your login credentials, sublicensing the Product, or otherwise using The Section Studio in a way that circumvents or undermines the restrictions of this license. Termination may also occur if payment obligations under a payment plan are not fulfilled. In the event of termination, you must immediately cease use of the sections and destroy any copies in your possession. Bungalow Creative further reserves the right to pursue legal or equitable remedies for any damages resulting from unauthorized use or distribution of the Product.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of The Section Studio shall be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut. By purchasing or accessing The Section Studio, you consent to personal jurisdiction and venue in those courts and waive any objection to inconvenient forum. Nothing in this section limits the right of Bungalow Creative to seek injunctive or equitable relief in any jurisdiction to protect its intellectual property rights.

These Terms constitute the entire agreement between you and Bungalow Creative regarding The Section Studio and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
